This book argues that there is a strong normative argument for using the criminal law as a primary response to corporate crime. In practice, however, corporate crimes are rarely dealt with through criminal sanctioning mechanisms. Rather, the preference - for both prosecutors and corporates - appears to be on negotiating out of the criminal process. Reflecting this emphasis on negotiation, this book examines the use of Civil Recovery Orders and Deferred Prosecution Agreements as responses to corporate crime, and discusses a variety of UK case studies. Drawing upon legal and criminological backgrounds, and with an emphasis on the conceptual frameworks of `negotiated justice' and `legitimacy', the authors examine the law, policy and practice of these enforcement responses. They offer an original, theoretically-informed analysis which is accessible to practitioners and researchers.

This book provides an analysis of whether the International Criminal Court can be regarded as an International Criminal World Court, capable of exercising its jurisdiction upon every individual despite the fact that not every State is a Party to the Rome Statute. The analysis is based on a twin-pillar system, which consists of a judicial and an enforcement pillar. The judicial pillar is based on the most disputed articles of the Rome Statute; its goal is to determine the potential scope of the Court's strength through the application of its jurisdiction regime. The enforcement pillar provides an analysis of the cooperation and judicial assistance mechanism pursuant to the Rome Statute's provisions and its practical implementation through States' practices. The results of the analysis, and the lack of an effective enforcement mechanism, demonstrate that the ICC cannot in fact be considered a criminal world court. In conclusion, possible solutions are presented in order to improve the enforcement pillar of the Court so that the tremendous strength of the ICC's judicial pillar, and with it, the exercise of worldwide jurisdiction, can be effectively implemented.

It examines the relationship between benefit sanctions and conditionality, shows how benefit sanctions have developed in the UK over the last 100 years, compares benefit sanctions in the UK first with benefit sanctions in other countries and secondly with other administrative penalties and court fines. These comparisons indicate that benefit sanctions are not only unusually harsh and cause real hardship but are also, in many important respects, incompatible with administrative justice and the rule of law. This book assesses the problems of punishment outside the courts, where few of the usual safeguards associated with punishment in the courts apply, and concludes by considering both what could be done about benefit sanctions and whether anything is likely to be done as long as work is prioritised over welfare.

Corporations may also try to `save' costs by not complying with environmental regulations and thus commit crimes of omission rather than commission. This book takes a different approach. Through a close reading of the institutional practices of one particular court, it demonstrates how court practices produce the subjectivity of the victim, a subjectivity that is profoundly of law and endogenous to the enterprise of international criminal justice. Furthermore, by situating these figurations within the larger aspirations of the court, the book shows how victims have come to constitute and represent the link between international criminal law and the enterprise of transitional justice. The book takes as its primary example the Extraordinary Chambers in the Courts of Cambodia (ECCC), or the Khmer Rouge Tribunal as it is also called. Focusing on the representation of victims in crimes against humanity, victim participation and photographic images, the book engages with a range of debates and scholarship in law, feminist theory and cultural legal theory. Nobody's Law shows how people - who are disappointed, disenchanted, and outraged about the justice system - gradually move away from law. Using detailed case studies and combining different theoretical perspectives, this book explores the legal consciousness of ordinary people, businessmen, and street-level bureaucrats in the Netherlands. The empirical research in this study tells an original and alternative narrative about the role of law in everyday life. While previous studies emphasize the law's hegemony and argue that it's `all over', Hertogh shows that legal proliferation makes it harder for people to know, and subsequently identify with, the law. As a result, official law has become increasingly remote and irrelevant to many people. The central finding presented in this highly topical text is that these developments signal a process of `legal alienation'- a gradual and mundane process with potentially serious consequences for the legitimacy of law. The Sociology of Everyday Life Peacebuilding
This book uses in-depth interview data with victims of conflict in Northern Ireland, South Africa and Sri Lanka to offer a new, sociological conceptualization of everyday life peacebuilding. It argues that sociological ideas about the nature of everyday life complement and supplement the concept of everyday life peacebuilding recently theorized within International Relations Studies (IRS). It claims that IRS misunderstands the nature of everyday life by seeing it only as a particular space where mundane, routine and ordinary peacebuilding activities are accomplished. Sociology sees everyday life also as a mode of reasoning. By exploring victims' ways of thinking and understanding, this book argues that we can better locate their accomplishment of peacebuilding as an ordinary activity. The book is based on six years of empirical research in three different conflict zones and reports on a wealth of interview data to support its theoretical arguments. This data serves to give voice to victims who are otherwise neglected and marginalized in peace processes.

The Sociology of Compromise after Conflict
This book introduces a new and original sociological conceptualization of compromise after conflict and is based on six-years of study amongst victims of conflict in Northern Ireland, South Africa and Sri Lanka, with case studies from Sierra Leone and Colombia. A sociological approach to compromise is contrasted with approaches in Moral and Political Philosophy and is evaluated for its theoretical utility and empirical robustness with in-depth interview data from victims of conflicts around the globe. The individual chapters are written to illustrate, evaluate and test the conceptualization using the victim data, and an afterword reflects on the new empirical agenda in victim research opened up by a sociological approach to compromise. This volume is part of a larger series of works from a programme advancing a sociological approach to peace processes with a view to seeing how orthodox approaches within International Relations and Political Science are illuminated by the application of the sociological imagination.

This book is a transnational study of rural and anti-Semitic violence around the triple frontier between Austria-Hungary, Romania and Tsarist Russia at the beginning of the twentieth century. It focuses on the devastating Romanian peasant uprising in 1907 and traces the reverberations of the crisis across the triple frontier, analysing the fears, spectres and knee-jerk reactions it triggered in the borderlands of Austria-Hungary and Tsarist Russia. The uprising came close on the heels of the 1905-1907 social turmoil in Tsarist Russia, and brought into play the major issues that characterized social and political life in the region at the time: rural poverty, the Jewish Question, state modernization, and social upheavals. The book comparatively explores the causes and mechanisms of violence propagation, the function of rumour in the spread of the uprising, land reforms and their legal underpinnings, the policing capabilities of the borderlands around the triple frontier, as well as newspaper coverage and diplomatic reactions.
