Legal Education at the Crossroads: Education and the Legal Profession
For several years legal professions across the world have, to varying degrees, been undergoing dramatic changes as a result of a range of forces such as globalization, diversification and changes in regulation. In many jurisdictions the extent of these transformations have led to a process of professional fragmentation and generated uncertainty at institutional, organisational and individual levels about the nature and future of legal professionalism. As a result legal education is in flux in many of jurisdictions including the United States, the UK and Australia, with further effects in other Common Law and some Civil law countries. The situation in the UK exemplifies the sense of uncertainty and crisis, with a growing number of pathways into law; an increasing surplus of law graduates to graduate entry positions and most recently proposals for reform of legal education and training by the Solicitors Regulation Authority (SRA). This collection addresses both current and historical approaches showing that some problems which appear to be modern are endemic, that there are still some important prospects for change and that policy issues may be more important than the interests of lawyers and educators. This makes this volume a source of interest to lawyers, law students, academic and policy makers as well as the discerning public. This book was previously published as a special issue of the International Journal of the Legal Profession.

The Globalisation of Urban Governance
The adoption of the Sustainable Development Goals (SDGs) by the UN General Assembly in 2015 represents the latest attempt by the international community to live up to the challenges of a planet that is out of control. Sustainable Development Goal 11 envisages inclusive, safe, resilient and sustainable cities around the world by the year 2030. This globally agreed vision is part of a trend in international policy toward good urban governance, and now awaits implementation. Fourteen original contributions collectively examine how this global vision has been developed on a conceptual level, how it plays out in various areas of (global) urban governance and how it is implemented in varying local contexts. The overarching hypothesis presented herein is that SDG 11 proves that local governance is recognised as an autonomous yet interrelated part of the global pursuit of sustainable development. The volume analyses three core questions: How have the normative ideals set forth in SDG 11 been developed? What are the meanings of the four sub-goals of SDG 11 and how do these relate to each other? What does SDG 11 imply for urban law and governance in the domestic context and how are local processes of urban governance internationalised? The Globalisation of Urban Governance makes an important scholarly contribution by linking the narrative on globalisation of good urban governance in various social sciences with legal discourse. It considers global governance and connects the existing debate about cities and their place in global governance with some of the most pertinent questions that lawyers face today.

The human genome is a well known symbol of scientific and technological progress in the 21st century. However, concerns about the exacerbation of inequalities between the rich and the poor, the developing and the developed states, the healthy and the unhealthy are causing problems for the progress of scientific research. The international community is moving towards a human rights approach in addressing these concerns. Such an approach will be piecemeal and ineffective so long as fundamental issues about economic, social and cultural rights, the so-called second generation of human rights, are not addressed. This book argues that, in order to be able to meaningfully apply a human rights framework to the governance of the human genome, the international human rights framework should be based on a unified theory of human rights where the distinction between positive and negative rights is set aside. The book constructs a common heritage concept with the right to development at its core and explores the content of the right to development through rational human rights theory. It is argued that the notion of property rights in the human genome should be placed within the context of protecting human rights, including the right to development. The concept of common heritage of humanity, contrary to the widely held belief that it is in opposition to patenting of gene sequences, supports human rights-based conceptions of property rights. This book fills a gap in the literature on international legal governance of the human genome will provide an essential reference point for research into the right to development, development issues in bioethics, the role of international institutions in law making and research governance.

Serving Whose Interests?: The Political Economy of Trade in Services Agreements
Serving Whose Interests? explores the political economy of trade in services agreements from a critical legal perspective. The controversy surrounding the General Agreement on Trade in Services (GATS) and its variants at the regional and bilateral levels can, it is argued, be seen as a clash between two paradigms. For most of the twentieth century, under welfare states and state socialism, these services were viewed from a local and national perspective as embodying a mix of economic, social and cultural dimensions and were managed by the state through strong regulation and direct ownership and delivery. That socially based and state-centred approach has been progressively displaced since the 1980s through neoliberal policies of privatisation, deregulation and liberalisation, the transnationalisation of finance and production, and new technologies. The internationalisation of services markets has thus become a driver of contemporary capitalism. The explicit aim of `trade in services' agreements is to lock in national regulations and policies that enhance the profitability of international services markets. They are exclusively the tools of contemporary global capitalism, yet are represented as the new pathway for development. It is argued here, however, that there is a fundamental contradiction between the global market model and the intrinsically social nature of services, whether they are social services like education, media and midwifery, or inputs to capitalist production such as finance, transport, energy, and telecommunications. This book examines and draws out these tensions and contradictions through a combination of theoretical analysis and a series of truly global case studies that include the market in internet gambling, education, pensions, electricity privatisation, supermarkets, tourism, oil, culture, temporary migrants, private finance initiatives and call centres. This book argues for the centrality of conflict in any notion of the political. In contrast to many of the attempts to re-think the political in the wake of the collapse of traditional leftist projects, it also argues for the logical and/or ontological primacy of violence over 'peace'. The notion of the political expounded here is explicitly 'realist' and anti-utopian - in large part because the author finds the consequences of attempting to think 'the good life' to be far more damaging than thinking 'the tolerable life'. The political is not thought of as a means to implement the good life; rather, the political exists because the good life does not. Indeed, if one sees 'globalization', with its emphasis on efficiency and economy, as a threat to the autonomy of the political, then one ought to be wary of political ideologies that reduce the political to species of moral or legal discourse. As laudable as the aims of human rights activists or political theorists like Rawls and Habermas may be, the consequences of their thought and actions further reduce the scope and possibility of political activity by, in effect, criminalizing political opposition. Once 'universal' norms are instantiated, political opposition becomes impossible. A fully legalized, moralized, and pacified universe is a thoroughly depoliticized one as well. Academics and advanced students researching and working in the areas of political theory, legal theory and international relations will find this book of great interest.
