Shortlisted for Specsavers Non-Fiction Book of the Year 2018. `Eye-opening, funny and horrifying' Observer `Everyone who has any interest in public life should read it' Daily Mail You may not wish to think about it, but one day you or someone you love will almost certainly appear in a criminal courtroom. You might be a juror, a victim, a witness or - perhaps through no fault of your own - a defendant. Whatever your role, you'd expect a fair trial. I'm a barrister. I work in the criminal justice system, and every day I see how fairness is not guaranteed. Too often the system fails those it is meant to protect. The innocent are wronged and the guilty allowed to walk free. I want to share some stories from my daily life to show you how the system is broken, who broke it and why we should start caring before it's too late. A SUNDAY TIMES TOP TEN BESTSELLER FOR 24 WEEKS.

On Suicide Bombing
Like many people in America and around the world, Talal Asad experienced the events of September 11, 2001, largely through the media and the emotional response of others. For many non-Muslims, the suicide bomber quickly became the icon of an Islamic culture of death --a conceptual leap that struck Asad as problematic. Is there a religiously-motivated terrorism? If so, how does it differ from other cruelties? What makes its motivation religious ? Where does it stand in relation to other forms of collective violence? Drawing on his extensive scholarship in the study of secular and religious traditions as well as his understanding of social, political, and anthropological theory and research, Asad questions Western assumptions regarding death and killing. He scrutinizes the idea of a clash of civilizations, the claim that Islamic jihadism is the essence of modern terror, and the arguments put forward by liberals to justify war in our time. He critically engages with a range of explanations of suicide terrorism, exploring many writers' preoccupation with the motives of perpetrators. In conclusion, Asad examines our emotional response to suicide (including suicide terrorism) and the horror it invokes. On Suicide Bombing is an original and provocative analysis critiquing the work of intellectuals from both the left and the right. Though fighting evil is an old concept, it has found new and disturbing expressions in our contemporary war on terror. For Asad, it is critical that we remain aware of the forces shaping the discourse surrounding this mode of violence, and by questioning our assumptions about morally good and morally evil ways of killing, he illuminates the fragile contradictions that are a part of our modern subjectivity.

The Death Penalty: A Worldwide Perspective
The 4th edition of this authoritative study, now written jointly with Carolyn Hoyle, brings up-to-date developments in the movement to abolish the death penalty worldwide. It draws on Roger Hood's experience as consultant to the United Nations for the UN Secretary General's five-yearly surveys of capital punishment and on the latest information from a wide range non-governmental organizations and the academic literature. Not only have more countries abolished capital punishment, but amongst those that continue to retain it, the majority have been carrying out fewer executions. Legal challenges to mandatory capital punishment have been successful, as has the movement to abolish the death penalty for those who commit a capital crime when under the age of 18. This edition has more to say about the prospects that China will restrict and control the number of executions 'on the road to abolition'. Yet, despite such advances, this book reveals many human rights abuses where the death penalty still exists. In some countries a wide range of crimes are still subject to capital punishment, and the authorities often fail to meet the safeguards embodied in international human rights treaties to safeguard those facing the death penalty. There is evidence of police abuse, unfair trials, lack of access to competent defence counsel, excessive periods of time spent in horrible conditions on 'death row', and public, painful forms of execution. The authors engage with the latest debates on the realities of capital punishment, especially its justification as a uniquely effective deterrent; whether it can ever be administered equitably, without discrimination or error, and what influence relatives of victims should have in sentencing and public debate. For the first time it also discusses the problem of devising an alternative to capital punishment; especially, life imprisonment without the possibility of parole.

Principles of Criminal Law
Principles of Criminal Law, now in its seventh edition, takes a distinctly different approach to the study of criminal law, whilst still covering all of the vital topics found on criminal law courses. Uniquely theoretical, it seeks to elucidate the underlying principles and theoretical foundations of the criminal law, and aims to critically engage readers by contextualising and analysing the law. This edition continues to fulfil this remit, with additional insights from a new co-author, Professor Jeremy Horder, former Law Commissioner for England and Wales 2005-2010. Also new to this edition is an increased emphasis on key case law, further assisting those undergraduate readers who may be new to the subject area. This is essential reading for students seeking a sophisticated and critically engaging exploration of the subject.

The Commentary on the Rome Statute of the International Criminal Court: Observers' Notes, Article by Article
On 1st July 2008, the Rome Statute of the International Criminal Court entered into force enabling the ICC, as laid down in the Preamble to the Statute, to affirm that the most serious crimes of concern to the international community as a whole must not go unpunished and that their effective prosecution must be ensured by taking measures at national level and by enhancing international cooperation . In the second edition of their Commentary, Otto Triffterer and a number of eminent legal practitioners and scholars in the field of international criminal law give a detailed article-by-article analysis of both the Statute as well as the Elements of Crime and the Rules of Procedure and Evidence , adopted by the Assembly of States Parties in 2002, and the Regulations of the Court , adopted by the Judges of the ICC in 2004. The second edition is a substantially revised and significantly amended version of the first edition of 1999, considering the jurisprudence of the International Criminal Tribunal for the former Yugoslavia (ICTY) and the International Criminal Tribunal for Rwanda (ICTR) as well as other international, semi-international or national courts and the relevant literature since 1999. The Commentary will be an invaluable aid to all practitioners and scholars dealing with the Rome Statute and the jurisdiction established by its Complementarity Regime .
